It addresses the question a doctor&#8217;s note can&#8217;t: can this employee perform this job, right now, without putting themselves or others at risk? So they write &#8220;light duty for two weeks&#8221; and leave it to others to figure out what that means.<\/span><\/p>\n<p><b>Vague notes create three problems:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Supervisors guess at what &#8220;light duty&#8221; actually means<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Workers get placed into tasks that still injure them<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Nobody has a record of who decided what, or why<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Clearance should be written to the job description. Not against some generalized version of rest.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Ignoring What The Job Actually Demands<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Try asking employers to write a physical demand job description. See what happens.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">They can&#8217;t produce one.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You can&#8217;t ask a clinician on the planet Earth to make an informed decision without that form. Document job demands: write down weights, distances, postures, exposures, equipment, length of shift. Takes you an afternoon per position and eliminates nearly ALL of the guessing game.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Asking For Too Much Medical Information<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">This one gets expensive quickly.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Medical exams and inquiries must be job related and consistent with business necessity under the ADA. By sending a general release to a clinic and asking for the entire file, employers are exceeding that boundary. The EEOC has sued employers specifically for this behavior, including where family medical history was obtained as part of a fitness-for-duty exam.<\/span><\/p>\n<p><b>The rule is simple:<\/b><span style=\"font-weight: 400;\"> ask only for what the job requires. No file. No dates.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Then someone disputes a claim, or an inspector begins asking questions, and there is no way to document that the decision ever occurred. Documentation isn&#8217;t bureaucracy in this case &#8211; it&#8217;s the only evidence that the decision was ever made correctly.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What A Solid Process Looks Like In Practice<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Successful programmes all have certain features in common. None of them are complex. None of them need lots of money.<\/span><\/p>\n<p><b>Begin with the job, not the person.<\/b><span style=\"font-weight: 400;\"> Each safety sensitive position should have a written physical demands profile in a file cabinet well before anyone becomes injured. Create it once, use it for decades.<\/span><\/p>\n<p><b>Choose an experienced occupational health provider.<\/b><span style=\"font-weight: 400;\"> Occupational medicine clinicians focus on work capacity, not just recovery. That distinction is crucial when the question is whether someone can safely don a respirator or drive a forklift.<\/span><\/p>\n<p><b>Maintain the medical file separately.<\/b><span style=\"font-weight: 400;\"> Health data remains with the provider. The supervisor only sees restrictions\/capabilities, nothing else. This safeguards both the employee&#8217;s privacy and the company.<\/span><\/p>\n<p><b>Use plain language for your restrictions.<\/b><span style=\"font-weight: 400;\"> &#8220;Do not lift objects greater than 20 pounds, reach overhead, re-eval in 14 days&#8221; is fine. &#8220;Light duty&#8221; is not fine.<\/span><\/p>\n<p><b>Schedule a review date.<\/b><span style=\"font-weight: 400;\"> Each restriction should have an expiration and a planned check-in date so temporary restrictions don&#8217;t silently become permanent fixtures.<\/span><\/p>\n<p><b>Train the supervisors.<\/b><span style=\"font-weight: 400;\"> They are the ones enforcing restrictions on the floor.
